Helms Burton Act extended the territorial application of the initial ban to apply to overseas companies trading with Cuba, and penalized foreign companies allegedly “trafficking” in property formerly owned by U.S. citizens but confiscated by Cuba after the Cuban revolution.
MSC is involved in cargo operations at the Cuba’s Port of Mariel was sued by Cuban-American Blanco Rosell family saying they should receive the profits that the container carrier is making by delivering cargo at this port. This port was given to them on 70 year lease agreement before the revolution. In recent past years, similar lawsuits have come up to other shipping companies like Maersk, CMA CGM as well.
